The short version

GraphixOS is a tool for making comics and graphic novels. What you make with it is yours. You pay for the AI generation you use, you can stop whenever you like, and there are rules about what you may create, which live in the Content Policy.

There are two things worth reading properly rather than skimming: what happens to your money when you cancel, and what GraphixOS does not promise. Both are below.


Who you are agreeing with

GraphixOS is operated by Mac McClellan, a sole proprietor based in Florida, United States. GraphixOS is a trading name, not a separate company. When these terms say "GraphixOS" or "I", they mean the same person.

Who can use GraphixOS

You must be 18 or over. Creating an account means accepting these terms, and that requirement is one of them.

The reason is the material rather than the technology. GraphixOS supports mature themes, the writing assistant will write to the tone your project asks for, and you can import your own images. That combination is not suitable for children. If I learn that an account belongs to someone under 18 it will be closed and its data removed, including the image files.

You also need to be able to enter a contract where you live, and to use GraphixOS for yourself rather than on behalf of an organisation that has not agreed to these terms.


Your account

Sign in is handled by Clerk. Keep your login details to yourself: anything done through your account is treated as done by you.

One account per person. Do not share an account, and do not create extra accounts to get more than one free trial. That is the one form of abuse that costs real money here, since every generation is paid for at the moment it runs.

If something looks wrong with your account, email me before assuming the worst. It is far more likely to be a fault than a decision.


What you make is yours

You own what you create on GraphixOS. Your story, your prose, your characters, your lore, your panel descriptions and the images generated from them. GraphixOS claims no ownership of any of it and takes no licence to use it for anything beyond running the product for you.

To be specific about what that means technically: GraphixOS needs permission to store your work, show it back to you, and send the necessary parts of it to the AI services that do the generating. That is the whole of the permission taken, it exists so the product can function, and it ends when you delete your work.

Your work will not appear in any marketing without your say-so. If I ever want to show something you made, I will ask you first.

Two honest points about AI-generated images, because they affect what "yours" is worth:

  • Copyright law has not settled on AI-generated images. In the United States, work with no human authorship may not be protectable by copyright at all. Nobody can tell you today exactly what rights you hold in an image a model generated from your prompt. What I can tell you is that GraphixOS is not claiming any of them.
  • Generated images are not exclusive. The same model, given a similar prompt by somebody else, can produce something similar. GraphixOS cannot promise that what you generate is unique.

You are responsible for what you do with your work once it leaves here, including anything you publish or sell.


What you may and may not create

The rules are in the Content Policy, and they apply to everything on the platform: written work, generated images, and images you import. In summary, you confirm you have the right to any image you import, and you may not create or import sexual content involving minors, defamatory or sexual depictions of real identifiable people, harassment, or material promoting illegal activity.

The Content Policy is part of these terms. If you break it, your account can be suspended or removed.


Copyright complaints and takedowns

GraphixOS lets you import your own images, so material can end up here that somebody else owns.

If you believe something on GraphixOS infringes your copyright, email admin@graphixos.com. Include:

  • what the material is and where you saw it, with the web address if you have it
  • what original work it copies, and enough for me to identify that work
  • your name and how to contact you
  • a statement that you believe in good faith the use is not authorised, and that what you have told me is accurate

Reports are read by a person. Material that is infringing will be removed. Accounts that repeatedly infringe will be closed.

Being straight with you about the process: GraphixOS is one person, not a legal department. There is no registered copyright agent and no formal notice-and-counter-notice machinery. What there is, is an address that reaches me and a commitment to act on what arrives there.

If you think something was removed unfairly, email me and say so.


Plans, Bytes and payment

Bytes are the unit GraphixOS bills in. Every AI action costs Bytes: generating an image, writing with the assistant, extracting panels from a scene. The current costs and plan prices are on the Billing page in the product, because they change more often than this document does.

The free trial runs for 14 days from the day you sign up. It includes a starting balance of Bytes and a limited version of the product: one chapter, three scenes, five pages, and exports that carry a watermark. The app counts the trial down on screen: a notice appears as the end approaches, showing the days remaining, becomes more prominent in the final days, and says plainly when the trial has ended. The trial applies to free accounts only. If you subscribe, nothing expires: the plan simply renews until you cancel it.

When the trial ends, the AI features stop and nothing else does. Your work is not deleted. You can still open every project, write, edit, reorder and lay out pages, and everything you do is still saved. What stops is anything that spends Bytes: generating images, the writing assistant, and extracting panels from a scene.

What you can take with you. Your writing always exports in full and free: the premise, all the prose, the character bible and the lore database. The comic itself exports one page at a time as a watermarked image unless you are on a paid plan, or have been on one at some point, in which case the packaged CBZ and PDF stay available to you. Your work is kept for at least 90 days, and what happens after that is set out under Suspending or ending an account below.

The paid plan, Creator, is billed monthly through Stripe. It is the only plan, so there is no moving up or down between plans. Your card details never reach GraphixOS.

How the two kinds of Bytes behave, because this is the part people get caught by:

  • Your monthly allowance resets at each billing date. Unused allowance Bytes do not carry over. The month starts fresh.
  • Top-up packs are different. Bytes you buy in a pack are added separately, they do carry over from month to month, and a renewal never touches them. Allowance is spent first, then top-ups.

More about top-up Bytes. Packs can be bought while you are on the paid plan. They sit in a separate balance, so your monthly allowance is always spent first and a top-up is only used once that month's allowance is gone. If you cancel, the balance is still there if you come back, but nothing can be spent while no plan is active, because that is when the AI features are switched off. If the account is deleted, the balance is deleted with everything else. Bytes are not money, which is set out under Refunds below.

Cancelling. You can cancel at any time from the Billing page. You keep everything you paid for until the end of the period you have already paid for. After that the AI features stop and nothing else does: your work stays where it is, you can still open, edit and export it, and it is kept for at least 90 days. What happens after that is set out under Suspending or ending an account below.

Refunds. There are no refunds for part of a month, and top-up packs are not refundable once bought. Bytes are not money: they cannot be exchanged for cash, transferred to anyone else, or cashed out when you leave. Cancel whenever you like, and use what you have paid for until the period you paid for ends.

When a generation fails, the Bytes come back automatically. Failing means it errored, timed out or returned no image. It does not mean an image you did not like, which has still used the generation it paid for. If you think you have been charged for something that never arrived, email me and I will look at your account and put it right.

Price changes. If a price goes up for a plan you are already on, you get at least 30 days notice by email before it applies, and it only ever takes effect at your next billing date. If you do not want to pay the new price, cancel before then.


Keeping your work safe

Your work is saved to your account on the server, and the copy your browser keeps is only a cache, so clearing your browser data does not lose anything.

That said: export your work. GraphixOS is a small product run by one person on hosted infrastructure. Backups, outages and bugs are all things I take seriously and none of them are things I can guarantee. The export is there for a reason, and the safest habit is to use it. If your work matters to you, do not let this be the only place it exists.


Suspending or ending an account

Two different things, and they do different things.

CANCELLING stops the billing. Your plan runs to the end of the period you have already paid for. After that the AI features stop, and nothing else does: everything you made is still there, you can open it, write, edit and lay out pages, and it all still saves. Because you have paid at some point, your comic still exports in full, in the packaged formats, and your writing always does. Your work is kept for at least 90 days, and after that the account and everything in it may be deleted, including your image files. That is a floor, not a deadline: it will not happen sooner and it may well be a good deal later. Take a copy while you can, because that is the only thing that makes your work independent of this product.

If a free trial ends and you never subscribed, the treatment is the same in every respect but one: an account that has never paid exports the comic one watermarked page at a time. The writing still comes out in full.

DELETING destroys the account, immediately. No waiting period, no undo, no grace window. Your projects, your written work, your characters and lore, your billing history and your image files are all destroyed at once. Anything you have not downloaded is gone. Your email address goes with it: it is used once to send a confirmation and then it is removed, so you get no come-back offers and you are on no list.

⚠️ If you have time left on a paid plan, deleting throws it away. The product will say so and offer you the alternative. Cancel, use what you have paid for, and delete afterwards if you still want to. Deleting does not refund anything.

Both are in the product. Deleting asks you to confirm, tells you plainly what is about to be destroyed, and offers cancelling instead. If you would rather it was done for you, or somebody needs an account closed on another person's behalf, email admin@graphixos.com.

I can suspend or close an account that breaks these terms or the Content Policy, that is used to work around the free trial, or where payment fails and is not fixed.

If that happens you will normally be told why and given a chance to download your work first. The exception is material that is illegal or that harms someone, where it may be removed straight away. That is not a licence to delete your work on a whim: it is there for content that cannot sit on a server while we talk about it.


What GraphixOS does not promise

GraphixOS is provided as it is. It works, it is used every day, and it is also a young product built by one person and changing constantly.

  • No guarantee that it is always available. It depends on services I do not run, including the AI providers, and any of them can be slow or down.
  • No guarantee about what the AI produces. Generated text and images can be wrong, off-model, repetitive, or simply not what you had in mind. You are paying for the attempt, not for a result you like, so an image you look at and decide against has still cost the Bytes it took to make. Getting a character or a scene right often takes more than one try, and each try is charged. A generation that FAILS is a different thing, and it is not charged: if it errors, times out, or returns nothing at all, the Bytes go back automatically.
  • The AI models will change. Better ones appear, and GraphixOS moves to them. Output from a new model will not match output from the old one.
  • Features can change or be removed, particularly while the product is this young.

None of that is an excuse for breaking things carelessly. It is a statement that this is a product under active development, sold as such.


Limits on liability

To the extent the law allows:

  • GraphixOS is not liable for indirect or consequential loss, including lost profits, lost opportunities, or the value of work you lose.
  • Total liability for anything connected with GraphixOS is limited to what you have actually paid in the twelve months before the claim. For a free account, that is nothing.

Some places do not allow limits like these, and where that is true, they do not apply to you.

You are responsible for what you create and publish, including anything you import and anything you go on to sell. If somebody brings a claim against GraphixOS because of what you made, that is yours to answer for.


Changes to these terms

If these terms change in a way that affects your rights or what you pay, the change is noted here with its date, and for a price change you get 30 days notice by email. Small corrections are made without ceremony. The version you agreed to when you signed up is kept on record.

Carrying on using GraphixOS after a change means you accept it. If you do not, cancel.


Law and disputes

These terms are governed by the law of the State of Florida, United States, and any dispute goes to the courts there.

Before that, email me. Nearly everything that looks like a dispute is a misunderstanding, a billing error or a bug, and all three are fixed faster by a message to admin@graphixos.com than by anything formal. I will answer as quickly as I can.
